MINUTES
COMMISSION MEETING
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY

Tuesday, November 19, 2002 - 2:00 p.m.
Commission Chambers, Weber Center, Ogden, Utah

Each Commission meeting is recorded on CD or audio tape, which is available to the public through the County Clerk's Office.

In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance "in brief" of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.

Commissioners Present: Chair Glen H. Burton and Commissioner Camille T. Cain. Commissioner Kenneth A. Bischoff was excused.
  1. Welcome by Chair Burton.

  2. Pledge of Allegiance was conducted by Fatima Blackford.

  3. Thought of the Day was offered by Chair Burton.

  4. Consent Items:
    1. Purchase Orders in the amount of $122,404.61.

    2. Warrants #169250 - #169882 in the amount of $655,864.86 and #169883 - #170113 in the amount of $536,632.59.

    3. Minutes of meeting held on November 5, 2002.

    Commissioner Cain moved to approve the consent items; Chair Burton seconded, both voting aye.

  5. Non-Action Items: None.

  6. Action Items:
    1. Contract with the U.S. Forest Service Providing a Revised Financial and Operating Plan for October 1, 2002 Through September 30, 2003 - Contract C2002-153
      Weber County Sheriff Brad Slater stated that the contract had been revised based on the Sheriff's annual operating costs to reflect two changes from the previous contract: 1) moving the baseline rate to $30/hour instead of $24 and 2) $47.16/hour for an overtime rate to patrol for the Forest Service. Sheriff Slater stated that the total contract amount of $60,000 did not change, but there would be a reduction in the number of hours that the Sheriff's Office would provide service. Additionally, this contract would allow the Sheriff's department the flexibility to assign on-duty personnel.

      Commissioner Cain moved to approve Contract C2002-153 between Weber County (Sheriff's Office) and the U.S. Forest Service providing a revised Financial and Operating Plan for October 1, 2002 through September 30, 2003; Chair Burton seconded, both voting aye.

    2. Contract with Wasatch Slopes Chariot Racing Assoc., Beehive Chariot Racing Assoc., Skyline Chariot Racing Assoc. and Bear River Chariot Racing Assoc. for Chariot Races at the Golden Spike Event Center from 12/21/2002 to 2/8/2003 - Contract C2002-154
      Jim Harvey, GSEC, stated that the reason for this partnership was to help perpetuate chariot racing. Mr. Harvey said this was a standard hourly-type contract and there would be gate receipts. He addressed Commissioner Cain's questions regarding contract item #3 relating to optional space and/or service.

      David Wilson, Deputy County Attorney, asked Mr. Harvey if the County Attorney's Office had reviewed the contracts he was presenting today. Mr. Harvey said that these particular "weekly races" contracts had not been reviewed, that they were the same as the ones reviewed by the County Attorney's Office for the last two years, however, this contract had a severability clause as well as a change to the liability clause. Mr. Wilson pointed out some needed changes and asked that approval be subject to review by the County Attorney's Office.

      Commissioner Cain moved to approve Contract C2002-154 between Weber County and Wasatch Slopes Chariot Racing Assoc., Beehive Chariot Racing Assoc., Skyline Chariot Racing Assoc. and Bear River Chariot Racing Assoc. for chariot races to be held at the Golden Spike Event Center from December 21, 2002 to February 8, 2003 subject to review by the County Attorney's Office and any required changes; Chair Burton seconded, both voting aye.

    3. Contract with Wasatch Slopes Chariot Racing Assoc. and Beehive Chariot Racing Association for a Benefit Chariot Race to be Held at the Golden Spike Event Center, 12/14/2002 - Contract C2002-155
      Jim Harvey, GSEC, stated that this contract was for an invitational fun run to benefit the Freedom Riders/McKay Dee Foundation.

      Commissioner Cain moved to approve Contract C2002-155 between Weber County and Wasatch Slopes Chariot Racing Assoc. and Beehive Chariot Racing Association for a benefit chariot race to be held at the Golden Spike Event Center on December 14, 2002; Chair Burton seconded, both voting aye.
    4. Contract with Star Touring and Riding Association for the National Yamaha Star Touring and Riding Summer Rally to be Held at the Golden Spike Event Center 7/22/2002 to7/25/2003 - Contract C2002-156
      Jim Harvey, GSEC, stated that this was a standard contract with the National Yamaha Star Touring and Riding Association and their activity would be similar to a Harley Davidson event held in 2001 at the GSEC. Yamaha would be utilizing the Recreation Building, Exhibit Hall and courtyard and the parking lot north of these buildings. The anticipated attendance is approximately 2,500-3,500 people.

      Commissioner Cain moved to approve Contract C2002-156 between Weber County and Star Touring and Riding Association for the National Yamaha Star Touring and Riding Summer Rally to be held at the Golden Spike Event Center 7/22/2002 to7/25/2003; Chair Burton seconded, both voting aye.
    5. Contract with Weber County and Westland Title for Access to the Weber County Recorder's Office On-Line information - Contract C2002-157
      Doug Crofts, County Recorder, presented this standard contract for computer access.

      Commissioner Cain moved to approve Contract C2002-157 between Weber County and Westland Title for access to the Weber County Recorder's Office on-line information; Chair Burton seconded, both voting aye.
    6. Final Approval of Moose Hollow Condominium Phase 4, 36 Units, and the Acceptance of the Financial Guarantee for $286,512.40
      Jim Gentry, County Planning Department, stated that this project was in the Wolf Creek area. The petitioner was proposing three more buildings (36 units). Mr. Gentry said that the Weber County Township Planning Commission unanimously recommended approval of this item.

      Commissioner Cain moved to grant final approval of Moose Hollow Condominium Phase 4, 36 units, and the acceptance of the financial guarantee for $286,512.40; Chair Burton seconded, both voting aye.
    7. Set Public Hearing Date for December 17, 2002 at 2:00 p.m. to Rezone Property at 6741 North Fork Road from Forest F-5 to Forest Residential FV-3
      Jim Gentry, County Planning Department, stated that the petitioner had property adjacent to some additional FV-3 and wished to rezone his property from F-5 to FV-3. He indicated that the Township Planning Commission unanimously recommended approval of this item and there had been no opposition to it at the Planning Commission meeting.

      Commissioner Cain moved to set a public hearing date for December 17, 2002 at 2:00 p.m. to rezone property at 6741 North Fork Road from Forest F-5 to Forest Residential FV; Chair Burton seconded, both voting aye.
  7. Assign Pledge of Allegiance and Thought of the Day for Tuesday, November 26, 2002, 2:00 p.m.

    Commissioner Cain moved to adjourn the public meeting and convene a closed executive session to discuss imminent and/or ongoing litigation; Chair Burton seconded.
