MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, September 25, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Jan M. Zogmaister, Vice Chair, and Craig L. Dearden. Kenneth A. Bischoff, Chair, was excused and Commissioner Zogmaister conducted the meeting.

Others Present: Alan D. McEwan, Clerk/Auditor; Chris Allred, Deputy County Attorney; Fátima Fernelius, Clerk/Auditor’s Office, took minutes.

D. Consent Items:
1. Purchase orders in the amount of $101,516.74
2. Warrants #229724 - #229980 in the amount of $1,403,056.66
3. Minutes for the meeting held on September 18, 2007
4. New Business Licenses
5. ACH payment to US Bank in the amount of $31,264.27 for purchasing card transactions through billing cycle ending September 17, 2007
Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, both voting aye.


E. Action Items:

1. Approval of a Second Agreement for installation of a paved pathway along 3600 W. for the safety of children walking to school - Contract C2007-236

Chris Allred, Deputy County Attorney, stated that this was very similar to the contract entered into last week for another section of a paved pathway in the unincorporated island of the Plain City vicinity on 3600 W. The only change is that this was a one-time payment lease for the property rather than an outright purchase of the property.
Commissioner Dearden moved to approve Contract C2007-236, a Second Agreement for installation of a paved pathway along 3600 W. for the safety of children walking to school; Commissioner Zogmaister seconded, both voting aye.

6. Final approval for The Cascades at Moose Hollow Phase 7 (12 units) located at approximately 5168 E. Fairway Loop and acceptance of a financial guarantee in the amount of $150,581.30

Sean Wilkinson, County Planning Department, stated that this was for the last two buildings in this project and that all concerns had been addressed. The Planning Commission had unanimously recommended approval of this item.
Commissioner Dearden moved to grant final approval for The Cascades at Moose Hollow Phase 7 (12 units) located at approximately 5168 E. Fairway Loop and acceptance of a financial guarantee in the amount of $150,581.30; Commissioner Zogmaister seconded, both voting aye.

7. Final approval of Daybreak Subdivision with a deferral for curb, gutter and sidewalk

Justin Morris, County Planning Department, stated that this 1-lot (1 acre) subdivision was located at approximately 4225 W. 1400 S. All improvements had been installed. This property was located within 1 ½ miles of a school and the petitioner was requesting deferral of curb, gutter and sidewalk. The Weber School District had responded during review of this subdivision stating that all students were eligible for busing. The Planning Commission had unanimously recommended final of approval of this item on July 10 with the requested deferral.
Commissioner Dearden moved to grant final approval of Daybreak Subdivision with deferral for curb, gutter and sidewalk; Commissioner Zogmaister seconded, both voting aye.

F. Public Hearings:

1. Commissioner Dearden moved to adjourn the public meeting and convene the public hearings; Commissioner Zogmaister seconded, both voting aye.

2. Public hearing on a petition for removal of land from an Agriculture Protection Area by David Hobbs, LSN 15-049-0031

Fátima Fernelius, Clerk/Auditor’s Office, stated that the statutory process had been followed. Commissioner Zogmaister invited public comments. Carolyn Bird, 155 N. 4600 W. asked how this would affect her property and the commissioners explained what agriculture protection areas were and noted that this action should not affect the Bird’s property.

3. Public hearing to vacate Lot 9 of Monastery Cove Subdivision Phase 1 including utility easement located therein

Sean Wilkinson, County Planning Department, stated that this item was a result of an amendment to the existing subdivision and was to follow a new process enacted by the county for housekeeping purposes. This subdivision changed a boundary line so that a building on adjacent property would have the proper setbacks. There were no pubic comments.

4.Commissioner Dearden moved to adjourn the public hearings and reconvene the public meeting; Commissioner Zogmaister seconded, both voting aye.

5. Action on public hearings:

F.2. - Public hearing on a petition to remove LSN 15-049-0031 from an Agriculture Protection Area
Commissioner Dearden moved to approve the petition by David Hobbs to remove LSN 15-049-0031 from an Agriculture Protection Area; Commissioner Zogmaister seconded, both voting aye.

F.3. - Public hearing to vacate Lot 9 of Monastery Cove Subdivision Phase 1 & utility easement - Ordinance 2007-27
Commissioner Dearden moved to adopt Ordinance 2007-27 vacating Lot 9 of Monastery Cove Subdivision Phase 1 and the utility easement ; Commissioner Zogmaister seconded.

3. Contract with Stirrin’ Dirt LLC for a Demolition Derby to be held on October 6, 2007 at the Golden Spike Event Center - Contract C2007-238

Commissioner Dearden moved to approve Contract C2007-238 by/between Weber County and Stirrin’ Dirt LLC for a Demolition Derby to be held October 6, 2007 at the Golden Spike Event Center; Commissioner Zogmaister seconded, both voting aye.

4. Contract with Professional Rodeo Cowboys Association for the Dodge Wilderness Circuit Finals Rodeo (PRCA/WCF) to be held December 27-29, 2007 at the Golden Spike Event Center - Contract C2007-239

Commissioner Dearden moved to approve Contract C2007-239 by/between Weber County and Professional Rodeo Cowboys Association for the Dodge Wilderness Circuit Finals Rodeo (PRCA/WCF) to be held on the dates of December 27, 28 and 29, 2007 at the Golden Spike Event Center; Commissioner Zogmaister seconded, both voting aye.

5. Contract with Professional Rodeo Cowboys Association for the 2008 Dodge Wilderness Circuit Finals Rodeo (PRCA/WCF) at the Golden Spike Event Center - Contract C2007-240

Jim Harvey, GSEC, presented this contract.
Commissioner Dearden moved Contract C2007-240 by/between Weber County and Professional Rodeo Cowboys Association for the 2008 Dodge Wilderness Circuit Finals Rodeo (PRCA/WCF) at the Golden Spike Event Center; Commissioner Zogmaister seconded, both voting aye.
