MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, October 30, 2007 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Jan M. Zogmaister, Vice Chair, and Craig L. Dearden. Kenneth A. Bischoff, Chair, was excused and Commissioner Zogmaister conducted the meeting.

D. Consent Items:
1. Purchase orders in the amount of $101,762.93
2. Warrants #230797-#231080 in the amount of $3,167,907.41

4. Approval of an ACH payment to US Bank in the amount of $42,118.66 for purchasing card transactions through the billing cycle ending October 15, 2007
5. Set public hearing for December 6, 2007, 6:00 p.m.,to receive public comments on the Weber County 2008 Tentative Budget
Commissioner Dearden moved to approve the consent items as presented; Commissioner Zogmaister seconded, both voting aye.
E. Action Items:

1. Adoption of the 2008 Weber County Tentative Budget

Dan Olsen, County Comptroller, noted that the budget detail would be presented at the hearing scheduled for December 6, 2007. Departments had been asked to submit a no-growth budget. He presented a balanced budget with no tax increase. This budget included about $1.8 million for equipment and capital improvements, a 2% COLA for employees, and the health and dental insurance increase was 5.1%. Mr. Olsen outlined a few items that needed to be addressed before the public hearing. The budget will be available on the county’s website or at the Clerk/Auditor’s Office.
Commissioner Dearden moved to adopt the 2008 Weber County tentative budget; Commissioner Zogmaister seconded, both voting aye.

2. Contract with Titan Development, etal, granting a nonexclusive utility easement to Titan Development for the construction of an underground sanitary sewer line and an underground storm sewer line within a portion of the Rail Trail Corridor - Contract C2007-265

Nate Pierce, County Operations Director, noted that Paul Southwick, of Titan Development, was present to address any questions. Titan Development was doing a development adjacent to the Rail Trail corridor and needed to install an underground sanitary sewer line and storm water sewer line to service their development. The county was the property owner, however, the Division of Wildlife Resources and Weber Pathways jointly held a conservation easement on that property. In addition, Plain City had an interest in the property because the area was located within their annexation plan.
All parties were now comfortable with this agreement. In exchange for a non-exclusive utility easement along portions of the Rail Trail, Titan Development will pay $124,000 to Weber County, which in turn commits to use the funds for future improvements to the Rail Trail corridor, which will be determined in conjunction with Weber Pathways and the Utah Division of Wildlife Resources. Titan Development further agrees to place $150,000 in escrow for three years to guarantee satisfactory rehabilitation of damaged areas to the Rail Trail due to construction of the sewer lines. Mr. Southwick said that this project would also benefit Plain City and several subdivisions, and it was designed to accommodate as many as 4,000 homes that may eventually be built with access to the trail.
Commissioner Dearden moved to approve Contract C2007-265 by/between Weber County and Titan Development, etal, granting a nonexclusive utility easement to Titan Development for the construction of an underground sanitary sewer line and an underground storm sewer line within a portion of the Rail Trail corridor; Commissioner Zogmaister seconded, both voting aye.
Commissioner Dearden moved to approve Contract C2007-265 by/between Weber County and Titan Development, etal, granting a nonexclusive utility easement to Titan Development for the construction of an underground sanitary sewer line and an underground storm sewer line within a portion of the Rail Trail corridor; Commissioner Zogmaister seconded, both voting aye.

3. Request for Real Estate Sale Agreement with Maria J. Lara regarding Land Serial Number 04-042-0070

This item was held for a future meeting.

4. Contract with Rocky Mountain Power granting a perpetual easement and right-of-way over and across grantor’s land - Contract C2007-266

Nate Pierce, County Operations Director, noted that Steve Rush, representing Rocky Mountain Power, was present. Mr. Pierce stated that this perpetual easement ran across county-owned property at the trailhead of the Rail Trail on the north side of 4000 North. The easement affects about 1,600 sq. ft. of the county’s 1-acre parcel, LSN 19-003-0003. The contract amount is $823.00 for the easement.
Commissioner Dearden moved to approve Contract C2007-266, by/between Weber County and Rocky Mountain Power granting a perpetual easement and right-of-way over and across grantor’s land; Commissioner Zogmaister seconded, voting aye.

5. contract with State of Utah for reimbursement for services provided at the Children’s Justice Center - Contract C2007-267

Mark DeCaria, County Attorney, presented the annual renewal of the contract reimbursing Weber County for services it provided through the Weber Morgan Children’s Justice Center. The Center was under Weber County government, and the County Attorney’s Office facilitated the investigations and interviews of child abuse. This contract was for $297,885.00, which represented Weber County’s share of the money granted by the legislature for CJCs across the State. Commissioner Dearden noted that Rod Layton, Center Director, had mentioned to him that he wanted to make some changes to the contract. Mr. DeCaria was not aware of changes for this year and believed those were changes for next year, nevertheless, he said there were no changes to the contract amount. Nate Pierce, County Operations noted that Mr. Layton had mentioned to him today that he would like to make some minor language changes, however, that it was best to approve the contract and make those changes the next time. Mr. DeCaria addressed Commissioner Dearden’s question stating it appeared they had found a solution to some concerns regarding the amount of control the AG’s Office was exercising over the function of the Center.
Commissioner Dearden moved to approve Contract C2007-267, by/between Weber County and the State of Utah to reimburse services provided at the Children’s Justice Center; Commissioner Zogmaister seconded, both voting aye.

H. close the public meeting for the purpose of discussing the purchase, exchange or lease of real property
