MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, February 5, 2008 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners Present: Jan M. Zogmaister, Chair; Craig L. Dearden; and Kenneth A. Bischoff.

Others Present: Alan D. McEwan, Clerk/Auditor; David C. Wilson, Deputy County Attorney; Fátima Fernelius, Clerk/Auditor’s Office, took minutes.

D. Recognition of Gayle Harris as the 2008 Weber County Mother of the Year

Chair Zogmaister read the proclamation honoring Gayle Harris as the 2008 Weber County Mother of the Year. The commissioners expressed their support for Ms. Harris and thanked her for all that she does for family and community.

E. Consent Items:
1. Purchase orders in the amount of $669,412.02
2. Warrants #233855 - #234072 in the amount of $1,134,242.68
3. Minutes for the meeting held on January 29, 2008
4. Set public hearing for February 26, 2008, 10 a.m., regarding amendments to the Zoning Ordinance by adding “Small Wind Energy System” as conditional use in RE-15, A-1, A-2, A-3 & AV-3 Zones (Chapters 3, 5, 5-B, 6 & 7); amending Chapter 23, Supplementary & Qualifying Regulations, by adding Section 38, Wind Energy Conversion Systems (Small Wind Energy Systems), & by deleting portions of Section 25, Towers; & amending Chapter 1, General Provisions, Section 6, Definitions, by adding definitions for “Small Wind Energy System” & “Wind Turbine”
Commissioner Bischoff moved to approve the consent items; Commissioner Dearden seconded, all voting aye.


F. Action Items:

1. Approval of a financial guarantee in the amount of $490 for landscaping improvements for Commercial Services Unlimited

Justin Morris, County Planning Department, noted that this financial guarantee was for landscaping improvements for a conditional use permit approved by the Planning Commission in May 2007.
Commissioner Dearden moved to approve the $490 financial guarantee for landscaping improvements for Commercial Services Unlimited; Commissioner Bischoff seconded, all voting aye.

2. contract with Cleary Building Corp. for bowery construction at Fort Buenaventura - Contract C2008-28

Jennifer Graham, Recreation Facilities Director, stated that the funds for this covered picnic bowery came from a RAMP grant.
Commissioner Bischoff moved to approve Contract C2008-28 by/between Weber County and Cleary Building Corp. for bowery construction at Fort Buenaventura; Commissioner Dearden seconded, all voting aye.


3. Contract with CorEMR. L.C. for Electronic Medical Records and Software License Agreement for the Jail Medical System - Contract C2008-29

Chair Zogmaister noted that there were no review signatures on the contract summary sheet. Julia Richesson, WCCF, stated that the contract had been sent for review about one month ago and David Wilson, Deputy County Attorney, said that legal counsel had reviewed it. This software program provides electronic medical record keeping and will be used by nurses and clerical staff at the Weber County (Kiesel) correctional facility. Ms. Richesson addressed the commissioners’ questions relating to the contract cost. This had been a budget approved item. Commissioner Dearden wanted to ensure the approved contract amount was not exceeded
Commissioner Dearden moved to approve Contract C2008-29 by/between Weber County and CorEMR. L.C. for electronic medical records and software license agreement for the jail medical system, subject to appropriate contract review and signatures; Commissioner Bischoff seconded, all voting aye.

G. Public Hearing:

1. Commissioner Bischoff moved to adjourn the public meeting and convene the public hearing; Commissioner Dearden seconded, all voting aye.

2. Public hearing to amend the Weber County Zoning Ordinance, Chapter 37 Standards for Single Family Dwellings

Scott Mendoza, Planning Department, stated that this was a minor amendment so that Chapter 37 was updated and referred to the proper Building Code. Chair Zogmaister invited public comments and none were offered.

3. Commissioner Dearden moved to adjourn the public hearing and reconvene the public meeting; Commissioner Bischoff seconded, all voting aye.

4. Action on public hearing:

G.2. - Public hearing to amend County Zoning Ordinance, Chapter 37
Commissioner Bischoff moved to adopt Ordinance 2008-6 amending the Weber County Zoning Ordinance, Chapter 37, Standards for Single Family Dwellings; Commissioner Dearden seconded.
