MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, August 12, 2008 - 10:00 a.m.
Commission Chambers, Weber Center, Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.
Commissioners Present: Jan M. Zogmaister, Chair, and Craig L. Dearden. Kenneth A. Bischoff was excused.

Others Present: Alan D. McEwan, Clerk/Auditor; Monette Hurtado, Deputy County Attorney; Fátima Fernelius, Clerk/Auditor’s Office, took minutes.

D. Consent Items:
1. Purchase orders in the amount of $60,189.06
2. Warrants in the amount of $606,406.47
3. Minutes for the meeting held on August 5, 2008
Commissioner Dearden moved to approve the consent items, holding the minutes; Chair Zogmaister seconded, both voting aye.

E. Action Items:

1. Contract with Utah Central Railway to lease railroad tracks located at Weber County Transfer Station - Contract C2008-177

Gary Laird, Weber County Solid Waste Administrator, stated that the Transfer Station had been built as a rail-haul facility but had been converted to a truck-haul facility. He noted that a lot of money had been invested in the rail. Utah Central will lease the railroad tracks for $3/day/car to store their cars.
Commissioner Dearden moved to approve Contract C2008-177 with Utah Central Railway to lease railroad tracks located at Weber County Transfer Station; Chair Zogmaister seconded, both voting aye.

2. Contract with Jacobsen Construction for Change Order #4 to adjust guaranteed maximum price - Contract C2008-178

Lynnda Wangsgard, Weber County Library Director, presented this change order to the Pleasant Valley branch library contract that resulted on a credit to the contract of $18,486.00. She outlined those changes.
Commissioner Dearden moved to approve Contract C2008-178 with Jacobsen Construction for Change Order #4 to adjust the guaranteed maximum price; Chair Zogmaister seconded, both voting aye.

F. Public Hearings

1.Commissioner Dearden moved to adjourn the public meeting and convene the public hearings; Chair Zogmaister seconded, both voting aye.

2. Public hearing regarding the vacation of Knight’s Farm Subdivision

Ben Hatfield, County Planning Department, noted that the Commission had granted final approval of the Knight’s Farm Subdivision (located at 5351 W. 1600 S.) on 7/29/08 and this was to vacate the original subdivision. Chair Zogmaister invited public comments and none were offered.

3. Public hearing regarding the vacation of Lots 12 and 13 in Wolf Creek Subdivision #1

Sean Wilkinson, County Planning Department, showed area maps. He stated that on 7/22/08 the Commission had adopted an ordinance vacating a portion of Juniper Lane and also granted final approval of Wolf Creek Subdivision #1 First Amendment Lots 12 and 13, which incorporated the vacated portion of Juniper Lane. This amended subdivision replaces the original lots 12 and 13 of Wolf Creek Subdivision #1 and those lots will be vacated. He explained that such vacations helped to avoid potential future errors in the chain of title. Mr. Wilkinson noted that this subdivision was located within the boundary of the incorporated Town of Powder Mountain and the new subdivision plat would be recorded and lots 12 and 13 would be vacated before the official incorporation took place. Chair Zogmaister invited public comments and none were offered.

4.Commissioner Dearden moved to adjourn the public meeting and convene the public hearings; Chair Zogmaister seconded, both voting aye.

5. Action on public hearings:

F.2. - Vacation of Knight’s Farm Subdivision - Ordinance 2008-28
Commissioner Dearden moved to adopt Ordinance 2008-28 vacating the Knight’s Farm Subdivision; Chair Zogmaister seconded.

F.3. - Vacation of Lots 12 and 13 in Wolf Creek Subdivision #1 - Ordinance 2008-29
Commissioner Dearden moved to adopt Ordinance 2008-29 vacating lots 12 and 13 in Wolf Creek Subdivision #1; Commissioner Bischoff seconded.

G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, August 19, 2008, 10 a.m.

I. Public Comments: None

H. Motion to close the public meeting to discuss strategy related to pending or reasonably imminent litigation
Commissioner Dearden moved to close the public meeting and convene a closed executive session to discuss strategy related to pending or reasonably imminent litigation; Chair Zogmaister seconded.

Action will be taken on the closed executive session at the next Commission meeting.
