MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, December 29, 2009 - 10:00 a.m.
Commission Chambers, 2380 Washington Blvd., Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. D. Presentation of the “My Boss is a Patriot” award to two supervisors from the Weber County Sheriff’s Office.

Frank Maughan, representing the Secretary of the Defense of the United States, stated that there is a program where soldiers can recognize their supervisors for their efforts in trying to make the reservist’s life better as s/he deals with the civilian and military bosses. He stated that Lt. Mark Lowther and Captain Brett Haycock had been nominated for this award and they received patriot pins issued by the Department of Defense.

E. Consent Items:
1. Purchase Orders in the amount of $23,510.20
2. Warrants #257377-257675 in the amount of $2,044,652.79
3. Minutes for the meeting held on December 15, 2009
4. New business license
Commissioner Bischoff moved to approve the consent items; Commissioner Zogmaister seconded, all voting aye.

F. Action Items:

1. Amendment to the Transient Room Tax (TRT) Ordinance increasing the Tax from 4.10 percent to 4.25 percent - Ordinance 2009-33

Dan Olsen, County Comptroller, noted this was the second reading of the ordinance. In budget deliberations for 2010 it was recognized that revenues were falling because of the economy. State allows the TRT maximum rate to be 4.25%. The county has used the 4.1% for a number of years. This small increase (15 cents/hotel room night) will generate about $36,000/year. The change will be effective 4/1/2010.
Commissioner Zogmaister moved to adopt Ordinance 2009-33 amending Title 24-5, Transient Room Tax from 4.1% to 4.25%; Commissioner Bischoff seconded.

2. Amend the General Fund budget to allow for payment to the Weber Fire District for 2009 watershed fire protection services

Dan Olsen, County Comptroller, stated that last week the 2009 budget was amended and this item was missed.

It was discovered at the time of paying the 2009 bill from the Fire District, that the 2008 bill had been paid at the end of June 2009, which was after the books were closed. This item is for two years of payments in one budget year.
Commissioner Bischoff moved to amend the General Fund budget to allow for payment to the Weber Fire District for 2009 watershed fire protection services; Commissioner Zogmaister seconded, all voting aye.

3. Contract by/between Weber County/SMG & the Miss Weber County Pageant - Contract C2009-224

Jan Wilson, Weber County Fair, stated that this contract allowed the Miss Weber County Scholarship pageant to be held at the Peery’s Egyptian Theater on January 15, 2010.
Commissioner Zogmaister moved to approve Contract C2009-224 by/between Weber County/SMG and the Miss Weber County Pageant; Commissioner Bischoff seconded, all voting aye.

4. Resolution of the Board of Commissioners of Weber County appointing members to the Golden Spike Event Center Advisory Board - Resolution 44-2009

Jennifer Graham, County Facilities Director, stated that there were three Advisory Board positions were expiring at the end of the year. They had agreed to serve another term.
Commissioner Bischoff moved to adopt Resolution 44-2009 reappointing Lil Birt, Susan Cross, and Brent Heap with terms expiring 12/31/2013 to the Golden Spike Event Center Advisory Board; Commissioner Zogmaister seconded.

5. Contract with EC Power Systems to provide periodic maintenance and performance checks of 200k emergency power generator for IT server room - Contract C2009-225

6. Contract with EC Power Systems to provide periodic maintenance and performance checks of 500k emergency power generator for Weber Center - Contract C2009-226

Doug Dickens, County Operations Department, presented these two maintenance agreements.
Commissioner Bischoff moved to approve Contracts C2209-225 and C2009-226 with EC Power Systems to provide periodic maintenance and performance checks of of 200k emergency power generator for the IT server room and 500k emergency power generator for the Weber Center; Commissioner Zogmaister seconded, all voting aye.

7. Wildland Fire Participation Agreement by/among the Utah State Division of Forestry (Fire and State Lands), the Weber Fire District and Weber County - Contract C2009-227

Chair Dearden said that the State required this agreement in order to reimburse the county for wildland fires. David Wilson, Deputy County Attorney, stated that if the State assists the county with a fire, the county will have to pay half of the cost of the wildland fire. The State will pay the county for fire suppression costs incurred by the County/District outside of the county. Chair Dearden asked if Chief Dave Austin had any questions and he replied that the District’s questions had been addressed. Commissioner Zogmaister asked for clarification and Ted Black, Fire Marshall for Weber Fire District, replied that the county’s portion covered 1/8th month period for the Fire Warden and about a 5-6 month period for the Assistant Fire Warden, depending on the severity of the season. The District pays 100% of the remaining four months. The State, the county and the federal government assist in the payment of the Fire Warden during an 8th month period, the State and the District cover the cost of the Assistant Fire Warden for the certain period. This is the method set up by the State.
Commissioner Bischoff moved to approve Contract C2009-227, Wildland Fire Participation Agreement by/among the Utah State Division of Forestry (Fire and State Lands), the Weber Fire District and Weber County; Commissioner Zogmaister seconded, all voting aye.

8. Interlocal Agreement with Weber Human Services for felony DUI Court Therapist and Court Specialist services - Contract C2009-228

David Wilson, Deputy County Attorney, stated that the Weber Human Services (WHS) Board had approved this agreement. The County Attorney’s Office and WHS had applied for a grant for the specific purpose of treating felony DUI in hopes of helping those persons to stop drinking and driving. The grant is essentially granted to Weber County which passes the funds to WHS that pays for a full time therapist the first year and for the second year it is anticipated that it will provide for two.
Commissioner Zogmaister moved to approve Contract C2009-228, Interlocal Agreement with Weber Human Services for felony DUI Court therapist and court specialist services; Commissioner Bischoff seconded, all voting aye.
