MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, April 6, 2010 - 10:00 a.m.
Commission Chambers, 2380 Washington Blvd., Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to state law.Commissioners: Kenneth A. Bischoff, Chair, and Jan M. Zogmaister. Craig L. Dearden was excused.

Others Present: Alan D. McEwan, County Clerk/Auditor; David C. Wilson, Deputy County Attorney; Fátima Fernelius, of the Clerk/Auditor’s Office, took minutes.

D. Presentation of the Seal of Service Award to Angela Martin from Engineering Dept.

Dennis Richardson, County Engineering, read the submitted nomination. Curtis Christensen, County Engineer, and Chair Bischoff expressed thanks for Ms. Martin’s dedication, and she thanked everyone.

E. Consent Items:
1. Purchase Orders in the amount of $48,452.18
2. Warrants #260639 - #260788 in the amount of $334,201.82
3. Minutes for the meeting held on March 30, 2010
4. New business licenses
5. Surplus items from the Weber-Morgan Health Department, Clinical Nursing Services Division
6. Surplus vehicles from the Weber County Department of Operations
Commissioner Zogmaister moved to approve the consent items; Chair Bischoff seconded, both voting aye.

F. Action Items:

1. Contract with Haylee Mills for Legal Counsel to Indigent Defendants - Contract C2010-60

2. Addendum to an Agreement with Sean Young for Legal Counsel to Indigent Defendants - Contract C2010-61

David Wilson, Deputy County Attorney, addressed items F.1 and F.2.
F.1 - One of the indigent defense counsel that had contracted with the county became seriously ill and had to terminate his services. The applications received during the process to select indigent defense counsel were reviewed and Michael Bouwhis, Indigent Defense Coordinator, recommended Haylee Mills. The contract is in the amount of $64,300.

F.2 - Sean Young had previously entered into a contract for indigent defense with the county and this will add $2,000 more to that contract for Justice Court services. At the time of executing that contract it had been understood that the Weber Justice Court would shortly be closing and Mr. Bouwhis had misunderstood that there would be no need for Justice Court indigent defense counsel. The Weber County Justice court has simply joined with Roy and moved location.
Commissioner Zogmaister moved to approve Contract C2010-60 with Haylee Mills for legal counsel to indigent defendants and C2010-61, Addendum to an Agreement with Sean Young for legal counsel to indigent defendants; Chair Bischoff seconded, both voting aye.

 

3. Contracts with Wheeler Machinery for Lubrication and Maintenance on the following: CAT 966F - Contract C2010-62; CAT 950F - Contract C2010-63

Nate Pierce, County Operations Department Director, presented these contracts stating that they are standard for lubrication and maintenance equipment at the Transfer Station.
Commissioner Zogmaister moved to approve Contracts C2010-62 and C2010-63 with Wheeler Machinery for lubrication and maintenance of a CAT 966F and a CAT 950F, respectively; Chair Bischoff seconded, both voting aye.



4. Contract with Consolidated Engineering Laboratories for Construction Materials, Testing and Construction Inspection Services for the Animal Shelter Expansion - Contract C2010-64

Nate Pierce, County Operations Department Director, stated that this company was responsible for the quality assurance testing that needs to be conducted on the current animal shelter expansion. The contract amount is $16,901. Chair Bischoff asked if this amount had been included in the building financing and Mr. Pierce responded that it was.
Commissioner Zogmaister moved to approve Contract C2010-64 with Consolidated Engineering Laboratories for construction materials, testing and construction inspection services for the Animal Shelter expansion; Chair Bischoff seconded, both voting aye.

 

5. Request for Contract with Post Bros., LLC to provide storage/maintenance building and outdoor storage for equipment used by County Property Management

This item was held.

G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, April 13, 2010, 10 a.m.
