MINUTES
OF THE BOARD OF COMMISSIONERS OF WEBER COUNTY
Tuesday, November 30, 2010 - 10:00 a.m.
Commission Chambers, 2380 Washington Blvd., Ogden, Utah
In accordance with the requirements of Utah Code Annotated Section 52-4-7(1)(d), the County Clerk records in the minutes the names of all citizens who appear and speak at a County Commission meeting and the substance “in brief” of their comments. Such statements may include opinion or purported facts. The County does not verify the accuracy or truth of any statement but includes it as part of the record pursuant to State law.Commissioners: Kenneth A. Bischoff, Chair, Jan M. Zogmaister and Craig L. Dearden.

D. Consent Items:
1. Ratify Purchase Orders dated November 23, 2010 in the amount of $108,920.95
2. Purchase Orders dated November 30, 2010 in the amount of $21,085.10
3. Ratify Warrants #268531-#268868 in the amount of $2,642,982.62,dated November 23, 2010
4. Warrants dated November 30, 2010 - no warrant register had been prepared for this date
5. Surplus 2 Minuteman Autoscrubbers from the Weber County Sheriff’s Office
6. Minutes for the meetings held on November 9 and 16, 2010
7. ACH payment to US Bank in the amount of $65,416.09 for purchasing card transactions made through the billing cycle ending November 15, 2010
8. Set public hearing for December 7, 2010, 5 p.m., to receive input on county’s proposed 2011 budget
Commissioner Dearden moved to approve the consent items; Commissioner Zogmaister seconded, all voting aye.


E. Action Items:

1. Contract with Diagnostic Laboratories to provide portable lab, EKG, X-ray and Ultrasound services to Weber County Sheriff’s Office - Contract C2010-212

Rick Bingham, Weber County Corrections Nurse Administrator, presented this contract. Reed Richards, Deputy County Attorney, addressed the commissioners’ questions stating that the contract allows the services to be performed at the jail, rather than transporting to hospitals, which is a savings in security and manpower. The option to take an inmate to a hospital is still available. The pricing is per use, which was compared to what the county was paying through the Medicaid arrangement with hospitals, and this costs slightly less. The contract term is for 36 months with automatic renewals and has a 60-day cancellation clause.
Commissioner Zogmaister moved to approve Contract C2010-212 with Diagnostic Laboratories to provide portable lab, EKG, X-ray and ultrasound services to the Weber County Sheriff’s Office; Commissioner Dearden seconded, all voting aye.

 

2. Resolution providing notice of its intent to reappoint Kim Dohrer to the Weber Human Services Governing Board - Resolution 31-2010

David Wilson, Deputy County Attorney, noted that this board is comprised of 8 members–3 Weber County Commissioners, 2 Morgan County council members and 3 appointments by the Commission. Ms. Dohrer’s term expires 12/31/2010. She filled a partial term which was less than half of one term and then she served a full term but is eligible under the interlocal agreement and bylaws for another term.
Commissioner Dearden moved to adopt Resolution 31-2010 providing notice of its intent to reappoint Kim Dohrer to the Weber Human Services Governing Board; Commissioner Zogmaister seconded.

3. Contract with Utah Nordic Alliance/Ogden Nordic to groom the cross country track/course at North Fork Park’s for the winter season - Contract C2010-213

Jennifer Graham, County Facilities Director, stated that the grooming is done by volunteers. Nordic accepts donations and the county allows them to take a fee at the Park entrance. When Ogden Nordic holds an event at the Park, they pay the county $1/person.
Commissioner Zogmaister moved to approve Contract C2010-213 with Utah Nordic Alliance/Ogden Nordic to groom the cross country track/course at North Fork Park’s for the winter season; Commissioner Dearden seconded, all voting aye.

 

4. Contract with Weber Morgan Children’s Justice Center to roll over budget money from 2009-2010 to 2010-2011 - Contract C2010-214

Rod Layton was not present and Commissioner Dearden presented this contract. The Attorney General’s Office allows money in a budget year that is not expended to be rolled over to the next year’s budget for the CJC.
Commissioner Dearden moved to approve Contract C2010-214 with Weber Morgan Children’s Justice Center to roll over budget money from 2009-2010 to 2010-2011; Commissioner Zogmaister seconded, all voting aye.

5. Contract with CCC Promotions for a boxing event to be held at the Golden Spike Event Center on December 4, 2010 - Contract C2010-215

Jim Harvey, of the GSEC, presented this standard contract.
Commissioner Dearden moved to approve Contract C2010-215 with CCC Promotions for a boxing event at the Golden Spike Event Center on 12/4/2010; Commissioner Zogmaister seconded, all voting aye.

6. Contract with Utah Motocross Promotions for the Western Motocross Nationals to be held at the Golden Spike Event Center on December 10 & 11, 2010 - Contract C2010-216

Jim Harvey, of the GSEC, presented this contract.
Commissioner Zogmaister moved to approve Contract C2010-216 with Utah Motocross Promotions for the Western Motocross Nationals at the Golden Spike Event Center 12/10-11/ 2010 ; Commissioner Dearden seconded, all voting aye.

 

7. Approval of the 2011 wildland fire budget

Blain Hamp, with the State Division of Forestry, Fire and State Lands, stated that the fire suppression budget is $68,283, and he outlined the line items. The Warden’s salary is a three-way split between the State, Fire District and the county. Dave Vickers, Weber County Fire Warden, stated that fire control apparatus has been placed at Causey Estates and they will be placing another at Sourdough and possibly at other unincorporated county areas in order to have quicker response.
Commissioner Dearden moved to approve the 2011 wildland fire budget; Commissioner Zogmaister seconded, all voting aye.

8. Interlocal Agreement with Roy City Paramedics for paramedic services - Contract C2010-217

Brad Dee, County Human Services Department Director, stated that Roy provides services for the southwest and northwest parts of the county. The contract term is five years from 1/1/2011-12/31/2015. They also provide backup for paramedic services throughout the county if other departments are busy. The county will provide funding for 8 paramedics. The contract amount is $319,995.95, the same amount as the previous contract.
Commissioner Zogmaister moved to approve Contract C2010-217 with Roy City Paramedics for paramedic services; Commissioner Dearden seconded, all voting aye.

9. Retire Parcel Numbers 11-096-0008 and 05-048-0030

Ernest Rowley, County Recorder/Surveyor, noted that these parcels are a result of the county tax sale process. The Recorder/Surveyor’s Office reviews the parcels on the tax sale list and some of them, due to time constraints, are pulled from the sale for additional research. These two parcels were pulled from the 2010 tax sale list.

11-096-0008 - This 8'X8.49' parcel is included in the ownership of lot 2 within the subdivision and it appears to have been shown on the records due to a mapping error.
Commissioner Dearden moved to retire parcel 11-096-0008; Commissioner Zogmaister seconded, all voting aye.

05-048-0030 - In Mr. Rowley’s opinion, this parcel was created due to a mapping error. It has been on the tax records since 1954 when two adjacent property owners made an agreement to recognize a fence line separating their properties as the common boundary line. The maps created for that action were drafted in error and created this small parcel that actually does not exist.
Commissioner Zogmaister moved to retire parcel 05-048-0030; Commissioner Dearden seconded, all voting aye.

F. Public hearing

1. Commissioner Dearden moved to adjourn the public meeting and convene the public hearing; Commissioner Zogmaister seconded, all voting aye.

2. Public hearing regarding the Storm Water Management Plan

Curtis Christensen, County Engineer, gave an overview of the Storm Water Management Plan. The Utah Pollution Discharge Elimination System is a federal program for cleaning rivers and streams that was delegated to the State, which gave the responsibility to the local entities. Because no one entity can do all the work, the county signed an agreement with the cities in 2003 to assist in some of the areas. The State is to audit every community at least once every five years. Mike Tuttle, of County Engineering, noted that the Storm Water Management Plan’s six minimum control measures requires generating goals for compliance and the county will review its ordinances. The document will be available on the county’s website. He addressed the commissioners questions stating that public comments can be taken during the life of the document and that the original permit was extended and then revised, which is what the county is currently working on. Chair Bischoff invited public comments and none were offered.

3. Commissioner Zogmaister moved to adjourn the public hearing and reconvene the public meeting; Commissioner Dearden seconded, all voting aye.

4. Action on public hearing:

F.2.-Adoption of Storm Water Management Program Plan & Delegation of Authority

Mr. Tuttle explained that the commissioners would be certifying this plan and also delegating Nathan Pierce and Curtis Christensen as the individuals who can sign off on the annual reports in the future.
Commissioner Dearden moved to adopt the Storm Water Management Program Plan and the delegation of Authority as presented; Commissioner Zogmaister seconded, all voting aye.

Mr. Christensen thanked all those who have worked on this item and Chair Bischoff added the Commission’s thanks.

G. Assign Pledge of Allegiance & Thought of the Day for Tuesday, December 7, 2010, 5:00 p.m.
